In compliance with the duty of information stipulated in the applicable personal data protection regulations, as well as in Article 10 of Law 34/2002 of July 11, on Services of the Information Society and Electronic Commerce, it is communicated that this website is owned by Mastery Global, S.L. (hereinafter MOBILITY MASTERY), an entity dedicated to the provision of services in the field of legal, relocation and outsourcing assistance, aimed at companies, to meet their needs and inquiries as Users and/or Clients, both personal and professional.

This information constitutes and regulates the conditions of use, limitations of liability, and obligations that users of the Web page assume and commit to respect.

Definitions

“Page”: domain www.mobilitymastery.global with own advisory services available to Internet Users.

“User”: a natural person who uses or navigates the Page, in their own name or on behalf of the legal entity they represent.

“Content”: the pages that make up the entirety of this domain, which constitute the information and services that MOBILITY MASTERY makes available to Internet Users. They contain messages, texts, photographs, graphics, icons, logos, technology, links, textures, drawings, sound and/or image files, recordings, software, appearance, graphic design, and source codes, and, in general, any kind of material contained on the Page.

“Web”: a technical term that describes the system of access to information via the Internet, which is configured by pages made with HTML or similar language, and programming mechanisms such as java, javascript, PHP, or others. These pages designed and published under an Internet domain name are the result of the information that the owner makes available to Internet Users.

“Hyperlink”: a technique by which a User can navigate through different WEB pages, or through the Internet, with a simple click on the text, icon, button, or indicator that contains the link.

“Cookies”: technical means for “traceability” and tracking of navigation on WEB sites. They are small text files that are written on the User’s computer. This method has implications for privacy, so MOBILITY MASTERY will duly and reliably warn of their use at the time they are implemented on the Page.

Conditions of Use

The mere use of the Page grants the condition of User of the Page, whether a natural or legal person, and necessarily implies the complete, full, and unconditional acceptance of each and every one of the clauses and general conditions included in this Legal Notice. If the User does not agree with the clauses and conditions of use of this Legal Notice, they should refrain from using the Page.

This Legal Notice is subject to changes and updates, so the version published by MOBILITY MASTERY may be different each time the User accesses the Portal. Therefore, the User must read the Legal Notice each time they access the Page.

Through the Page, MOBILITY MASTERY provides Users with access and use of various Contents published through the Internet by MOBILITY MASTERY or by authorized third parties.

The User is obliged and commits to use the Page and the Contents in accordance with current legislation, the Legal Notice, and any other notice or instructions brought to their knowledge, either through this legal notice or in any other place within the Contents that make up the Page, as well as with the rules of coexistence, morals, and generally accepted good customs.

To this end, the User undertakes and commits NOT to use any of the Contents for illegal purposes or effects, prohibited in the Legal Notice or by current legislation, harmful to the rights and interests of third parties, or that in any way can damage, disable, overburden, deteriorate or prevent the normal use of the Contents, computer equipment or documents, files, and all kinds of content stored on any computer equipment owned or contracted by MOBILITY MASTERY, other Users, or any Internet user (hardware and software).

The User undertakes and commits not to transmit, disseminate or make available to third parties any kind of material contained on the Page, such as information, texts, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software, logos, trademarks, icons, technology, photographs, software, links, graphic design, and source codes, or any other material to which they had access in their capacity as a User of the Page, without this enumeration being limiting.

Furthermore, in accordance with all this, the User may not:

  • Reproduce, copy, distribute, make available, or otherwise publicly communicate, transform, or modify the Contents, unless they have the written and explicit authorization of MOBILITY MASTERY, who owns the corresponding rights, or if it is legally permitted.
  • Delete, manipulate, or in any way alter the “copyright” and other identifying data of the reservation of rights of MOBILITY MASTERY or its owners, fingerprints and/or digital identifiers, or any other technical means established for their recognition.
  • The User must refrain from obtaining and even attempting to obtain the Contents using means or procedures other than those which, according to the cases, have been made available to this effect or have been indicated to this effect on the WEB pages where the Contents are found or, in general, those that are habitually used on the Internet for this purpose, provided they do not entail a risk of damage or disablement of the Page, and/or the Contents.

Industrial and Intellectual Property

All trademarks, trade names, or distinctive signs of any kind that appear on the Page are the property of MOBILITY MASTERY or, where applicable, third parties who have authorized their use, without it being understood that the use or access to the Portal and/or the Contents gives the User any right over the aforementioned trademarks, trade names, and/or distinctive signs, and without it being understood that any of the exploitation rights that exist or may exist on said Contents are transferred to the User, nor is their use authorized, in any case, to users of the Page unless they obtain such rights in writing from the legitimate owner thereof.

Similarly, the Contents are the intellectual property of MOBILITY MASTERY, or third parties where applicable; therefore, the Intellectual Property rights are owned by MOBILITY MASTERY or by third parties who have authorized their use to MOBILITY MASTERY and it is to them who corresponds the exclusive exercise of the rights of exploitation of them in any form and especially the rights of reproduction, distribution, public communication, and transformation, and it is not understood that they are transferred nor is their use authorized, in any case, to the users of the Page unless they obtain such rights in writing from the legitimate owner thereof.

Unauthorized use of the information contained on this WEB, as well as the infringement of the Intellectual or Industrial Property rights of MOBILITY MASTERY or third parties included in the Page who have transferred content, will lead to the legally established responsibilities.

Those who intend to establish hyperlinks between their WEB page and the Page must observe and comply with the following conditions:

Prior authorization is not necessary when the Hyperlink only allows access to the homepage, but it may not reproduce it in any way. Any other form of Hyperlink will require the express and unequivocal written authorization of MOBILITY MASTERY.

  • The hyperlink is restricted to pages containing topics, names, materials, or information that are inappropriate, profane, defamatory, illegal, obscene, indecent, or illicit, nor materials or information that infringe any intellectual property rights, relevant privacy, or advertising rights.
  • No “frames” (“frames”) will be created with the WEB pages or on the WEB pages of MOBILITY MASTERY.
  • No false, inaccurate, or offensive statements or indications about MOBILITY MASTERY, its directors, its employees or collaborators, or of the people who relate on the Page for any reason, or of the Users of the Page, or of the Contents provided will be made.
  • It will not be declared or implied that MOBILITY MASTERY has authorized the Hyperlink or that it has supervised or assumed in any way the Contents offered or made available to the Web page where the Hyperlink is established.
  • The Web page where the Hyperlink is established may only contain what is strictly necessary to identify the destination of the Hyperlink.
  • The Web page where the Hyperlink is established will not contain information or content that is illegal, contrary to morals and generally accepted good customs and public order, nor will it contain content that is contrary to or infringes the rights of third parties.

Page Availability

MOBILITY MASTERY does not guarantee the absence of interruptions or errors in accessing the Page or its Content, nor that it is updated, although it will make its best efforts to, in case of such occurrences, avoid, correct, or update them. Consequently, MOBILITY MASTERY is not responsible for any damages of any kind caused to the User resulting from failures or disconnections in the telecommunications networks that produce the suspension, cancellation, or interruption of the Page service during the provision of the same or prior to it.

MOBILITY MASTERY excludes, with the exceptions contemplated in current legislation, any liability for damages of any kind that may be due to the lack of availability, continuity, or quality of the operation of the Page and the Contents, to the non-fulfilment of the utility expectation that users may have attributed to the Page and the Contents.

The function of the Hyperlinks appearing on this Page is exclusively to inform the user about the existence of other Pages that contain information on the subject. These Hyperlinks are not a suggestion or recommendation.

MOBILITY MASTERY is not responsible for the contents of such linked pages, the functioning or usefulness of the Hyperlinks, or the result of such links, nor does it guarantee the absence of viruses or other elements in them that could cause alterations in the computer system (hardware and software), documents, or files of the user, excluding any responsibility for damages of any kind caused to the user for this reason.

Access to the Page does not imply an obligation on the part of MOBILITY MASTERY to control the absence of viruses, worms, or any other harmful computer element. It is the User’s responsibility, in any case, to have adequate tools for the detection and disinfection of harmful computer programs, therefore, MOBILITY MASTERY is not responsible for possible security errors that may occur during the provision of the Page service, nor for the possible damages that may be caused to the user’s or third parties’ computer system (hardware and software), files, or documents stored therein, as a result of the presence of viruses on the user’s computer used for the connection to the services and contents of the Web, a malfunction of the browser, or the use of non-updated versions of it.

Page Quality

Given the dynamic and changing environment of the information and services provided through the Page, MOBILITY MASTERY makes its best efforts to ensure the complete truthfulness, accuracy, reliability, usefulness, and/or timeliness of the Contents.

The information contained in the pages that make up this Portal is provided to interested parties for informational, advisory, disseminative, and advertising purposes, among others.

Limitation of liability

The Contents on this Page should be understood as simply informative. MOBILITY MASTERY is not responsible for decisions made by the User based on the Contents.

This Page may publish content provided by third parties or companies. MOBILITY MASTERY is not responsible for the veracity and accuracy of the same, being exempt from any contractual or extra-contractual responsibility with the Users who make use of them.

MOBILITY MASTERY reserves the right to carry out, without prior notice, the modifications it deems appropriate to its Page, and may change, delete or add both the contents and services provided through it and the way in which they are presented or located.

Notifications

All notifications and communications made by the parties will be valid in accordance with the means allowed in law. Those related to this Page will be considered effective, for all purposes, if made through the Page itself.

Content Availability

The provision of the service of the Page and the Contents has, in principle, an indefinite duration. MOBILITY MASTERY, however, is authorized to terminate or suspend the provision of the Page service and/or any of the Contents at any time. When reasonably possible, MOBILITY MASTERY will warn previously of the termination or suspension of the Page.

Customer Service

MOBILITY MASTERY provides its clients with a Customer Service, which can be contacted through info@mobilitymastery.global or by calling the phone number on the website.

Confirmation of the complaint will be verified through an identification key and/or a written receipt or another durable medium.

Claims that may be presented by Users who hold the status of consumers under current legislation will be handled by MOBILITY MASTERY’s Customer Service and may be sent to any of the contact details specified in this legal notice, and will be answered by the appropriate means within a maximum period of 30 days.

In case of a complaint or unsatisfactory response by MOBILITY MASTERY, the consumer may address the consumer bodies of their autonomous community or resort to the platform of REGULATION (EU) 524/2013 of the European Parliament and of the Council, of 21 May, on the resolution of online consumer disputes (http://ec.europa.eu/odr).

Right of Withdrawal

The customer has a right of withdrawal in those cases legally recognized.

If it is a service contracted at a distance, you have the right to withdraw from the contract within 14 calendar days without justification. The withdrawal period will expire 14 calendar days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must notify by email to info@mobilitymastery.global  your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by postal mail, fax, or email). If you use one of these options, we will communicate without delay in a durable medium (for example, by email) the receipt of such withdrawal.

To meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the corresponding deadline expires.

Consequences of withdrawal: in case of withdrawal by you, we will refund all payments received from you, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from the contract. We will proceed to make the refund using the same means of payment used for the initial transaction unless you have expressly provided otherwise; in any case, you will not incur any expenses as a result of the refund.

If you have requested that the provision of services begins during the withdrawal period, you must pay a proportional amount for the part of the service already provided at the time you have communicated your withdrawal, in relation to the total object of the contract.

Jurisdiction

The Legal Notice is governed by Spanish law and the applicable personal data protection regulations.
